Before accessing agent-only features, tools, data, products, services, syndication workflows, lead generation tools, listing-related functionality, or other real estate professional services made available by HouseCanary, you must verify and attest that you are a licensed real estate agent in good standing.
By checking the box and clicking “I Agree and Verify My Agent Status,” you are entering into a legally binding agreement with HouseCanary, Inc. (“HouseCanary,” “we,” “us,” or “our”) and making the representations, warranties, acknowledgments, covenants, and agreements below.
You also acknowledge and agree that your access to and use of HouseCanary’s products, services, websites, tools, data, reports, platforms, and related functionality is subject to HouseCanary’s Terms of Use, available at https://www.housecanary.com/info/legal.
If you do not agree to this Agent Verification and Attestation and HouseCanary’s Terms of Use, do not proceed. You will not be approved for agent-level access.
1. Agent Status Attestation.
You represent and warrant that, as of the date you submit this verification:
a. You are a duly licensed real estate agent, salesperson, broker associate, broker, or other real estate professional authorized to perform real estate brokerage activities in the state or jurisdiction in which you operate.
b. Your real estate license is active, valid, current, and not expired, suspended, revoked, restricted, inactive, probationary, or otherwise impaired.
c. You are authorized under applicable law to conduct real estate brokerage activity and to access real estate professional tools, data, services, and listing-related functionality.
d. You are a member in good standing of each applicable multiple listing service, board, association, brokerage organization, or professional organization required for your real estate activities.
e. You are in good standing with your applicable MLS or MLSs.
f. You are in good standing with your applicable real estate board, association, or professional organization.
g. You are in good standing with your applicable state real estate commission, department of real estate, licensing authority, or other regulatory body.
h. You are in good standing with your broker, managing broker, brokerage, supervising broker, or responsible broker.
i. You are authorized by your broker, managing broker, brokerage, supervising broker, or responsible broker to access and use agent-only tools, data, listings, leads, services, and related HouseCanary functionality.
j. You have not been prohibited, restricted, suspended, terminated, or otherwise limited by any MLS, board, association, brokerage, regulator, licensing authority, or other governing body from accessing, using, receiving, displaying, transmitting, or acting upon real estate listing data, market data, property data, consumer inquiries, lead information, or real estate professional services.
2. Complaints, Investigations, Discipline, and Restrictions.
You represent and warrant that, as of the date you submit this verification:
a. You are not currently subject to any pending complaint, investigation, disciplinary proceeding, enforcement action, arbitration, ethics complaint, license review, MLS compliance action, board proceeding, brokerage disciplinary action, or regulatory action that would affect your authority to act as a real estate professional or use agent-only services.
b. You have not been notified of any pending or threatened suspension, restriction, revocation, probation, termination, fine, penalty, license action, MLS action, board action, or association action that would affect your authority to act as a real estate professional or use agent-only services.
c. You have not been barred, suspended, terminated, sanctioned, or restricted by any MLS, board, association, brokerage, state licensing authority, regulator, or real estate professional organization in a manner that would make your access to HouseCanary’s agent-level services improper or unauthorized.
d. You are not aware of any fact, condition, restriction, dispute, complaint, claim, or circumstance that would make your attestation inaccurate, misleading, incomplete, or false.
e. If any complaint, investigation, disciplinary matter, enforcement action, restriction, suspension, termination, or other event arises after you submit this verification that could affect your status, authority, MLS access, brokerage standing, license status, or eligibility to use agent-level services, you agree to notify HouseCanary immediately.
3. MLS Membership and Data Rights.
You represent and warrant that:
a. You are properly authorized to access, use, receive, display, transmit, and act upon any MLS, listing, property, market, lead, consumer, brokerage, or real estate data made available to you through HouseCanary.
b. Your use of HouseCanary’s services will comply with all applicable MLS rules, board rules, association rules, data licenses, brokerage policies, listing agreements, seller instructions, advertising rules, professional standards, fair housing laws, privacy laws, consumer protection laws, and all other applicable laws and regulations.
c. You will not use HouseCanary’s services in any way that violates any MLS rule, board rule, association rule, brokerage policy, data license, listing agreement, seller instruction, consumer consent requirement, law, regulation, or professional standard.
d. You are solely responsible for determining whether your use of any HouseCanary feature, data, workflow, listing functionality, lead tool, or syndication-related service is permitted under your MLS, board, association, brokerage, and legal obligations.
e. HouseCanary is not responsible for independently verifying your MLS membership, MLS permissions, brokerage permissions, data rights, professional standing, or legal authority.
4. Errors and Omissions Insurance.
You represent and warrant that:
a. You maintain errors and omissions insurance, professional liability insurance, or other insurance coverage required by your brokerage, MLS, board, association, state licensing authority, or applicable law.
b. Your insurance coverage is active and in good standing.
c. Your insurance coverage is sufficient for your real estate activities and your use of agent-level services, including any use of real estate data, listings, leads, consumer information, valuation information, advertising tools, marketing tools, syndication tools, or other HouseCanary services.
d. You will maintain all required insurance coverage for as long as you access or use HouseCanary’s agent-level services.
e. HouseCanary does not verify your insurance coverage and is relying solely on your attestation.
5. Agreement to HouseCanary Terms of Use.
You acknowledge and agree that your access to and use of HouseCanary’s products, services, websites, applications, tools, data, reports, platforms, integrations, content, and related functionality is also governed by HouseCanary’s Terms of Use, available at https://www.housecanary.com/info/legal.
By checking the acknowledgment box and clicking “I Agree and Verify My Agent Status,” you confirm that you have read, understand, and agree to this Agent Verification and Attestation and HouseCanary’s Terms of Use.
If there is any conflict between this Agent Verification and Attestation and HouseCanary’s Terms of Use, HouseCanary reserves all rights and remedies available under both documents to the fullest extent permitted by law.
6. Authorization to Verify Status.
You authorize HouseCanary to verify, re-verify, investigate, audit, or request information regarding your license status, MLS membership, brokerage affiliation, good standing, insurance status, complaints, disciplinary history, or eligibility to access agent-level services.
This may include contacting or reviewing information from your broker, managing broker, brokerage, MLS, board, association, state licensing authority, regulator, public licensing database, third-party verification provider, or other relevant source.
You agree to provide any documentation, license information, MLS information, brokerage confirmation, insurance documentation, or other information requested by HouseCanary to confirm your eligibility.
Failure to provide requested documentation may result in denial, suspension, restriction, or termination of your access.
7. Continuing Obligation to Maintain Eligibility.
Your attestation is not a one-time statement only. You agree that all representations and warranties in this attestation remain true for as long as you access or use HouseCanary’s agent-level services.
You agree to immediately notify HouseCanary if:
a. Your real estate license expires, becomes inactive, is suspended, is revoked, is restricted, or is otherwise impaired.
b. You leave your brokerage or change brokers.
c. You lose MLS access or MLS membership.
d. You are no longer in good standing with your MLS, board, association, state licensing authority, broker, managing broker, brokerage, or regulator.
e. You become subject to a complaint, investigation, disciplinary proceeding, enforcement action, license action, MLS compliance action, board proceeding, brokerage restriction, or similar matter.
f. You no longer maintain required E&O insurance or professional liability insurance.
g. Any representation, warranty, attestation, or statement you made during verification becomes inaccurate, incomplete, misleading, or false.
If any of these events occur, you must stop using agent-level services unless and until HouseCanary confirms that you remain eligible.
8. Access to Agent-Level Services.
You acknowledge that HouseCanary may provide access to certain features, products, tools, data, workflows, and services based on your representation that you are a licensed real estate agent in good standing.
These may include agent-only features, professional tools, listing-related services, lead-related services, syndication workflows, property data, market data, valuation tools, advertising tools, consumer contact tools, or other real estate professional services.
You acknowledge and agree that HouseCanary is relying on your attestation when determining whether to grant, maintain, suspend, or terminate your agent-level access.
You are solely responsible for the truth, accuracy, completeness, and continuing validity of your attestation.
9. No HouseCanary Liability for False or Inaccurate Attestations.
You agree that HouseCanary, its affiliates, vendors, partners, officers, directors, employees, agents, licensors, data providers, and service providers shall not be liable for any claim, dispute, fine, penalty, damages, loss, cost, expense, legal fee, settlement, regulatory action, MLS action, board action, brokerage action, consumer complaint, intellectual property claim, data misuse claim, privacy claim, or other liability arising out of or related to:
a. Your false, inaccurate, incomplete, misleading, unauthorized, or outdated attestation.
b. Your lack of authority to access or use agent-level services.
c. Your lack of required license status, MLS membership, board membership, brokerage standing, insurance, or regulatory good standing.
d. Your violation of MLS rules, board rules, association rules, brokerage policies, listing agreements, seller instructions, data licenses, consumer permissions, laws, regulations, professional standards, or HouseCanary’s Terms of Use.
e. Your use or misuse of any HouseCanary feature, product, service, data, tool, workflow, lead, listing functionality, or syndication-related service.
f. Any claim that HouseCanary provided agent-level access based on your false, inaccurate, incomplete, misleading, unauthorized, or outdated representation.
10. Agent Responsibility for False, Inaccurate, or Unauthorized Attestation.
If any representation, warranty, attestation, statement, or information you provide is false, inaccurate, incomplete, misleading, unauthorized, or no longer accurate, you agree that you are solely responsible for all resulting claims, disputes, fines, penalties, damages, losses, costs, expenses, legal fees, settlements, regulatory actions, MLS actions, board actions, brokerage actions, consumer complaints, and other liabilities.
This includes any amounts incurred by, asserted against, assessed against, or paid by HouseCanary, its affiliates, vendors, partners, officers, directors, employees, agents, licensors, data providers, or service providers as a result of your attestation, your access, your use of agent-level services, your violation of HouseCanary’s Terms of Use, or your conduct.
11. Pass-Through of Claims, Damages, Penalties, and Costs.
To the fullest extent permitted by law, any claim, demand, fine, penalty, damages, loss, cost, expense, legal fee, settlement amount, investigation cost, audit cost, regulatory cost, MLS cost, board cost, brokerage cost, consumer claim, or other liability asserted against or incurred by HouseCanary, its affiliates, vendors, partners, officers, directors, employees, agents, licensors, data providers, or service providers due to your false, inaccurate, incomplete, misleading, unauthorized, or outdated attestation, your use of agent-level services, or your violation of HouseCanary’s Terms of Use may be passed through to you for payment, reimbursement, defense, and resolution.
You agree to promptly reimburse HouseCanary for any such amounts upon request.
12. Indemnification.
You agree to defend, indemnify, and hold harmless HouseCanary, its affiliates, vendors, partners, officers, directors, employees, agents, licensors, data providers, and service providers from and against any and all claims, demands, fines, penalties, damages, losses, costs, expenses, legal fees, settlement amounts, investigation costs, audit costs, regulatory costs, MLS costs, board costs, brokerage costs, consumer claims, or liabilities arising out of or related to:
a. Your approval, verification, attestation, representation, warranty, or certification.
b. Your lack of authority to access or use agent-level services.
c. Any inaccurate, incomplete, misleading, unauthorized, outdated, or false statement made in connection with your verification.
d. Any actual or alleged violation of MLS rules, board rules, association rules, brokerage policies, listing agreements, seller instructions, data licenses, consumer consent requirements, laws, regulations, professional standards, or HouseCanary’s Terms of Use.
e. Any claim by an MLS, board, association, brokerage, broker, managing broker, state licensing authority, regulator, consumer, seller, buyer, agent, data provider, or other third party arising from your access to or use of HouseCanary’s services.
f. Any claim that HouseCanary improperly granted you access to agent-level services based on your verification, attestation, or representations.
g. Any misuse of real estate data, listing data, property data, market data, lead data, consumer data, contact information, valuation information, or other information made available through HouseCanary.
h. Any failure to maintain required licensing, MLS membership, board membership, brokerage affiliation, good standing, insurance, or other eligibility requirements.
i. Any failure to notify HouseCanary of a change in your license status, MLS status, board status, brokerage affiliation, insurance coverage, disciplinary status, or eligibility.
13. Suspension, Termination, and Revocation of Access.
HouseCanary may deny, suspend, restrict, revoke, or terminate your access to agent-level services at any time, with or without notice, if HouseCanary determines, suspects, or receives information suggesting that:
a. Your attestation is false, inaccurate, incomplete, misleading, unauthorized, or outdated.
b. You are not a licensed real estate agent in good standing.
c. You are not in good standing with your MLS, board, association, broker, managing broker, brokerage, state licensing authority, or regulator.
d. You do not maintain required E&O insurance or professional liability insurance.
e. You are subject to a complaint, investigation, disciplinary matter, enforcement action, suspension, restriction, termination, or other matter affecting your eligibility.
f. Your use of HouseCanary’s services may violate MLS rules, board rules, association rules, brokerage policies, data licenses, listing agreements, seller instructions, laws, regulations, professional standards, or HouseCanary’s Terms of Use.
g. Continuing to provide access may expose HouseCanary or its affiliates, vendors, partners, data providers, or service providers to risk, liability, dispute, penalty, or reputational harm.
HouseCanary has no obligation to reinstate access after suspension, restriction, revocation, or termination.
14. Disclosure of Verification and Attestation Records.
If any MLS, board, association, brokerage, broker, managing broker, state licensing authority, regulator, consumer, data provider, or other third party raises a concern, complaint, claim, audit, investigation, or dispute related to your access, status, eligibility, use of HouseCanary services, or professional standing, HouseCanary may disclose your verification record, approval record, attestation, account details, access history, usage information, and related documentation to that party to the extent HouseCanary determines is appropriate.
You acknowledge and agree that HouseCanary may use your attestation and related records to respond to complaints, claims, subpoenas, regulatory inquiries, MLS inquiries, board inquiries, brokerage inquiries, audits, investigations, disputes, or legal proceedings.
15. No Independent Duty to Verify.
You acknowledge and agree that HouseCanary may rely on your representations and warranties and has no obligation to independently verify your license status, MLS status, board status, brokerage status, insurance coverage, disciplinary status, authority, or eligibility.
Any verification HouseCanary performs is for HouseCanary’s benefit only and does not reduce, limit, or eliminate your responsibility for the truth, accuracy, completeness, and continuing validity of your attestation.
16. Electronic Signature and Legally Binding Agreement.
By checking the acknowledgment box and clicking “I Agree and Verify My Agent Status,” you agree that:
a. Your click constitutes your legally binding electronic signature.
b. Your click has the same legal effect as a handwritten signature.
c. You are entering into this attestation and agreement voluntarily.
d. You have read and understand this attestation.
e. You agree to be bound by all terms stated in this attestation.
f. You have read, understand, and agree to HouseCanary’s Terms of Use.
g. You understand that HouseCanary is relying on your verification, representations, warranties, acknowledgments, and agreements when granting agent-level access.
17. Acknowledgment.
I certify, represent, and warrant that I am a licensed real estate agent in good standing, that I am a member in good standing of my applicable MLS, board, association, brokerage, and state licensing authority, that I maintain required E&O insurance or professional liability insurance, that I have no current complaints, investigations, restrictions, suspensions, or disciplinary matters that would affect my eligibility, and that I have authority to access and use agent-level HouseCanary services.
I further certify, represent, and warrant that all information I have provided is true, accurate, complete, and current, and I agree that if any statement is false, inaccurate, incomplete, misleading, unauthorized, or outdated, I will be responsible for all resulting claims, damages, losses, fines, penalties, costs, legal fees, settlements, and liabilities, including any amounts incurred by or asserted against HouseCanary.
I agree to defend, indemnify, and hold harmless HouseCanary and its affiliates, vendors, partners, officers, directors, employees, agents, licensors, data providers, and service providers from and against any claims, damages, losses, costs, penalties, fines, legal fees, or liabilities arising out of or related to my verification, attestation, access, use of agent-level services, professional status, licensing status, MLS status, brokerage status, insurance status, violation of HouseCanary’s Terms of Use, or any false, inaccurate, incomplete, misleading, unauthorized, or outdated statement.
I acknowledge that I have read, understand, and agree to HouseCanary’s Terms of Use, available at https://www.housecanary.com/info/legal.
